Terms of Use

These terms apply to this website and to the INVL Hub software you can download from it. By using either, you agree to them. If you do not agree, please do not use the site or the software.

1. Products in development

INVL counters are in development and are not currently for sale. Nothing on this site is an offer to sell, and no product can be ordered or reserved here. Images of the counter and of places it is shown in are illustrations. Designs, specifications, features, pricing, and availability may change or be withdrawn at any time, and we do not promise that any product will be released.

2. The INVL Hub software

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use INVL Hub for your own home or business. You may not resell it, or remove or alter any notice in it. If a separate licence accompanies a download, that licence governs the software and prevails over this section.

INVL Hub stores your inventory data on your own computer. You are responsible for that computer, for keeping your own backups, and for the security of the network your counters use.

3. What INVL is, and is not, for

INVL is a counting aid. It records what people enter into it, and it can be wrong: a press can be missed or repeated, a device can lose power or its network connection, and people forget to press. It does not guarantee stock levels, and you remain responsible for checking counts and for every ordering, purchasing, and operating decision you make.

Do not rely on INVL where an inaccurate count could cause harm, including tracking medication, controlled substances, medical supplies, safety equipment, food-safety or temperature compliance, or anything else where a missed or wrong count could lead to injury, illness, or a regulatory breach.

4. No warranty

THE SITE, THE SOFTWARE, AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT COUNTS WILL BE ACCURATE.

5. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SALES, SPOILED OR EXPIRED STOCK, STOCKOUTS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR SOFTWARE, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AND ONE HUNDRED US DOLLARS.

Some jurisdictions do not allow some of these exclusions, so some may not apply to you.

6. Indemnity

You agree to defend and hold us harmless from claims by third parties arising from your misuse of the site or software, or your breach of these terms.

7. Acceptable use

Do not use the site to break the law, submit false or someone else's information, interfere with the site's operation, or attempt to access systems you are not authorised to use.

8. Our content and marks

INVL, the INVL wordmark, and the content of this site belong to INVL LLC. You may not use them without our written permission, except to refer to our products accurately.

9. Links to other services

Software downloads are hosted on GitHub. Your use of GitHub, and of any other service we link to, is governed by that service's own terms and privacy policy.

10. Governing law and disputes

These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Hamilton County, Ohio, and you and we consent to their jurisdiction.

11. Changes

We may update these terms. The effective date above tells you when they last changed. Continuing to use the site or software after a change means you accept the updated terms.

Early Access Terms

These terms apply to the early access list and its discounts, in addition to the Terms of Use.

1. Signing up is not a purchase

Joining the list costs nothing and creates no obligation on either side. It is not an order, a deposit, or a reservation of any product, and it does not guarantee that a product will be released, or when.

2. How discounts are assigned

• Tiers are assigned in the order valid sign-ups are received, by the time recorded on our systems.
• The first 50 valid sign-ups receive 30% off. The first 500 valid sign-ups, including those 50, are eligible for at least 10% off. Every valid sign-up after that receives 5% off.
• We will tell you which tier you were assigned.

3. What the discount covers

• The discount applies to your first order only, and to no more than the first 10 counters in that order. Any counters beyond 10 are charged at the list price.
• The discount is a percentage off the list price in effect when you order, and applies before tax and shipping.
• It cannot be combined with other offers, exchanged for cash, or transferred to another person or business.
• It is honoured on a first order placed within six months of the date counters first become available to order. We will tell you when that date arrives, by the email or phone number you gave us. After six months, it expires.

4. One per person and per business

Each person, and each business, may hold one place on the list. Duplicate, automated, false, or bulk sign-ups are not valid, and we may remove them and reassign tiers accordingly.

5. Eligibility

You must be at least 18 years old. The offer is available only where counters are eventually sold and shipped, and is void where prohibited.

6. Changes to the program

We may change or end the early access program. If we do, we will still honour, under these terms, any discount already assigned to you before the change.

Privacy Policy

This policy explains what we collect through this website, why, and what you can do about it.

1. What we collect

What you give us. If you join the early access list we collect the details you enter: an email address or phone number, and optionally your name, business name, location, how many counters you might want, the kind of place you run, and what you would track.

What is collected automatically. Like most websites, our hosting provider may log basic technical information such as your IP address, browser type, and the pages you request. When you open the download page, your browser contacts GitHub to fetch details of the latest release, which shares your IP address with GitHub under GitHub's privacy statement. We do not use advertising or tracking cookies, and we do not track you across other websites. Because there is no such tracking to switch off, the site does not change its behaviour in response to "Do Not Track" browser signals.

2. What the software does not collect

INVL Hub stores your inventory on your own computer and does not send your inventory data to us. Your counters talk only to that computer, over your own network.

3. How we use your information

• To tell you when counters are available, and to honour the discount assigned to you.
• To understand demand and plan how many counters to build.
• To operate, secure, and improve this site, and to comply with the law.

4. How we contact you

We will contact you only about early access and the availability of INVL products, by the method you gave us. If you gave us a phone number, you agree that we may call or text it for that purpose. Message and data rates may apply. You can stop email by replying or using the unsubscribe link, stop texts by replying STOP, and stop calls by telling us. Agreeing to be contacted is not a condition of any purchase.

5. Who we share it with

We do not sell your personal information, and we do not share it with anyone for their own marketing. We share it only:

• With service providers who process it on our behalf, such as our website host and email provider, who may use it only to provide those services to us;
• When required by law, or to protect our rights, safety, or property; and
• With a successor if our business is merged, acquired, or sold, in which case this policy continues to apply to your information.

6. How long we keep it

We keep your sign-up details until counters launch and your discount has expired or been used, or until you ask us to delete them, whichever comes first, unless the law requires us to keep them longer.

7. Your choices and rights

You can ask us to access, correct, or delete your information, or take you off the list, at any time by emailing invlmanagement@gmail.com. Depending on where you live, including California and other US states, you may have additional rights, and we will not treat you differently for exercising them.

8. Children

This site is not directed at children under 13, and we do not knowingly collect their information. If you believe a child has given us information, contact us and we will delete it.

9. Security

Sign-up details are sent over an encrypted connection and are encrypted again before they are stored, with a key that is not kept on the server that stores them. We use reasonable measures to protect your information, but no method of transmission or storage is completely secure, and we cannot guarantee it.
